Terms & Conditions

These Terms & Conditions govern access to and use of the PharmaSpark mobile application, website and related services.

About These Terms

These Terms & Conditions ("Terms") govern your access to and use of the PharmaSpark mobile application, website, and related services (collectively, the "Service").

PharmaSpark ("PharmaSpark", "we", "us", or "our") is an educational and examination-preparation platform designed primarily for pharmacy students and aspirants.

By creating an account, accepting these Terms where prompted, purchasing or accessing applicable services, or otherwise using the Service after these Terms become applicable to you, you agree to comply with these Terms, subject to applicable law.

Please read these Terms carefully before using PharmaSpark.

Eligibility And Account Registration

You must satisfy the age, capacity, and consent requirements applicable to you under relevant law and platform requirements.

Where consent or authorization from a parent or legal guardian is required, PharmaSpark should only be used after the required consent or authorization has been obtained.

When creating or maintaining an account, you must provide information that is accurate and reasonably complete.

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to protect access to your account and device.

You must not knowingly share passwords, OTPs, authentication credentials, or account access in a manner that compromises the security of your account or the Service.

If you believe your account has been accessed without authorization, contact PharmaSpark through Help & Support as soon as reasonably possible.

PharmaSpark Services

PharmaSpark may provide educational and examination-preparation features including:

  • Subject-wise Learning
  • MCQ practice
  • Educational notes and learning resources
  • Previous Year Questions (PYQs)
  • Mock Tests
  • Daily Challenges
  • Leaderboards and rankings
  • Learning progress and performance insights
  • Examination-preparation resources
  • Notifications
  • Help & Support
  • Other educational features made available through the Service The availability, content, functionality, eligibility requirements, and access conditions of individual features may change as PharmaSpark develops, maintains, and improves the Service.

Educational Purpose

PharmaSpark is an educational and examination-preparation platform.

Content available through PharmaSpark is intended to assist learning, revision, practice, and examination preparation.

PharmaSpark does not guarantee:

  • Selection in any examination
  • Admission to any institution
  • A particular examination rank
  • A particular score or result
  • Employment or recruitment
  • Professional qualification or licensing
  • That any particular question will appear in an examination Academic and examination outcomes depend on multiple factors beyond the use of PharmaSpark.

Users remain responsible for checking official examination notifications, eligibility requirements, syllabi, schedules, rules, instructions, and other authoritative information issued by the relevant examination authority or institution.

Educational Content And Corrections

PharmaSpark seeks to provide useful, relevant, and reasonably accurate educational content.

Educational material, examination patterns, official syllabi, guidelines, and related information may change over time. Despite reasonable review processes, content may occasionally contain an error, ambiguity, outdated information, formatting issue, or technical problem.

PharmaSpark may correct, update, replace, reorganize, or remove educational content when reasonably necessary.

Where appropriate, information associated with previously completed attempts may be preserved so that historical results remain understandable and consistent after content is corrected or updated.

Users may report suspected content issues through available reporting or Help & Support functionality.

PYQs And Examination-Related Material

Where PharmaSpark identifies material as a Previous Year Question (PYQ), examination-related question, or similar resource, it is provided for educational and examination-preparation purposes.

Official examination authorities may change examination patterns, syllabi, marking schemes, eligibility requirements, schedules, or other rules.

Unless expressly stated otherwise, PharmaSpark is not an official examination authority and is not affiliated with, sponsored by, or endorsed by an examination body merely because an examination name, question, syllabus, logo-free reference, or related educational information appears within the Service.

Users should rely on the relevant official authority for final examination notifications, eligibility requirements, dates, rules, syllabi, and instructions.

Account Use And Acceptable Conduct

Your PharmaSpark account is intended for your authorized personal use unless PharmaSpark expressly provides another form of access.

You must not:

  • Sell, rent, transfer, or commercially redistribute your account
  • Obtain or attempt to obtain unauthorized access to another user's account
  • Circumvent subscription, authentication, or access restrictions
  • Manipulate attempts, scores, rankings, challenges, or leaderboards
  • Exploit or attempt to exploit technical vulnerabilities
  • Interfere with the security, availability, or normal operation of the Service
  • Use bots, scripts, scraping tools, or other automated systems to systematically extract protected content or data without authorization
  • Reverse engineer or circumvent security controls except where such restriction is prohibited by applicable law
  • Use PharmaSpark for fraudulent, unlawful, abusive, or harmful activity PharmaSpark may investigate activity reasonably suspected of violating these Terms or compromising the Service.

Daily Challenges And Leaderboards

Daily Challenges, rankings, eligibility requirements, scoring rules, and leaderboard criteria may be governed by feature-specific rules displayed within PharmaSpark.

Participation does not guarantee any particular rank, recognition, or outcome.

PharmaSpark may review, correct, invalidate, or exclude activity reasonably identified as fraudulent, manipulated, duplicated, abusive, invalid, or technically corrupted.

Where challenge or leaderboard criteria change, updated criteria may apply prospectively to the relevant challenge or ranking period.

Subscriptions And Paid Access

Certain PharmaSpark features may require an active paid subscription or another authorized access entitlement.

Before completing a purchase, users should review the plan, price, duration, included access, and other information presented for that purchase.

Paid access may be activated after successful payment and transaction verification.

A successful payment instruction or payment-provider response does not necessarily mean access has been activated until the transaction has been successfully received or verified by the systems responsible for the purchase.

Access to paid features generally continues for the duration associated with the purchased plan, subject to these Terms and any specific conditions disclosed at the time of purchase.

When a subscription or access period expires, features requiring active paid access may become unavailable unless access is renewed, extended, or otherwise authorized.

Purchasing access to PharmaSpark does not transfer ownership of PharmaSpark's educational content, software, branding, or other intellectual property to the user.

Pricing And Plan Changes

PharmaSpark may introduce, modify, discontinue, or restructure plans, features, durations, or pricing.

Unless otherwise required by applicable law or specifically disclosed for a purchase, a prospective price change does not by itself alter the amount already paid for a completed purchase.

The plan information and purchase conditions presented for a transaction determine the applicable purchased access, subject to these Terms and applicable law.

Payments

Payments may be processed through an authorized payment service provider or platform billing system, depending on how and where the purchase is made.

You are responsible for providing valid payment authorization and for complying with any applicable terms of the payment provider or billing platform.

Transactions may be subject to verification before paid access is activated.

Failed, pending, interrupted, reversed, disputed, or incorrectly reported transactions may require verification before access can be activated, restored, or otherwise adjusted.

PharmaSpark may process transaction references and related payment information reasonably necessary to verify purchases, manage access, reconcile transactions, investigate payment issues, and provide payment-related support.

PharmaSpark does not request UPI PINs, CVVs, banking passwords, or payment OTPs through Help & Support.

Refunds, cancellations, failed-payment adjustments, duplicate-payment matters, and related requests, where applicable, are governed by the Refund/Cancellation Policy made available through PharmaSpark and by any mandatory rights available under applicable law or the applicable payment platform.

Intellectual Property

Unless otherwise indicated, PharmaSpark and the original materials made available through the Service, including educational content, notes, explanations, content organization, application design, branding, graphics, software, and other proprietary materials, are owned by or licensed for use by PharmaSpark and may be protected by applicable intellectual-property laws.

PharmaSpark grants users a limited, personal, non-exclusive, non-transferable right to access and use the Service and available content for authorized educational purposes, subject to these Terms.

Except where permitted by applicable law or expressly authorized by PharmaSpark, you must not reproduce, republish, sell, commercially distribute, systematically extract, modify for redistribution, or commercially exploit PharmaSpark's proprietary materials.

Nothing in these Terms transfers ownership of PharmaSpark intellectual property to a user.

Third-Party Services

PharmaSpark may use or provide access to third-party services such as authentication providers, payment or billing providers, infrastructure services, external websites, or other resources.

Third-party services operate independently and may be governed by their own terms and privacy policies.

PharmaSpark is not responsible for the independent operation, availability, content, policies, or practices of third-party services that it does not control.

Use of a third-party service may also be subject to that provider's applicable terms.

Service Availability And Maintenance

PharmaSpark seeks to provide a reliable Service, but uninterrupted or error-free availability cannot be guaranteed.

The Service or particular features may occasionally be unavailable or affected because of maintenance, updates, infrastructure problems, internet or network conditions, third-party service interruptions, security incidents, technical failures, or circumstances outside PharmaSpark's reasonable control.

PharmaSpark may perform maintenance, updates, security changes, repairs, or other operational work when reasonably necessary.

Changes To Features And Content

PharmaSpark may improve, modify, replace, reorganize, suspend, or discontinue features or educational content where reasonably necessary for product development, educational quality, security, compliance, maintenance, or operational requirements.

Where a change materially affects an existing paid entitlement, the matter will be handled in accordance with applicable law and the conditions associated with the relevant purchase.

Suspension And Termination

PharmaSpark may restrict, suspend, or terminate access where reasonably necessary because of:

  • A material or repeated violation of these Terms
  • Fraudulent or abusive activity
  • Unauthorized account access, transfer, or misuse
  • Manipulation of scores, attempts, challenges, or rankings
  • Attempts to compromise the security or operation of PharmaSpark
  • Unlawful use
  • A legal or regulatory requirement
  • A material security risk

Where appropriate and reasonably practicable, PharmaSpark may provide notice or an opportunity to address the issue.

Immediate action may be taken where reasonably necessary to protect users, PharmaSpark, the Service, or to comply with applicable legal requirements.

Nothing in this section is intended to remove rights or remedies that cannot lawfully be excluded.

Account Deletion

Eligible users may request account deletion through account-related functionality made available within PharmaSpark or through the account-deletion process provided on the PharmaSpark website.

Account deletion may permanently remove access to learning progress, attempt history, account-specific information, and other associated functionality.

Certain information may be retained where reasonably necessary or legally required, including records relating to completed financial transactions, accounting, security, fraud prevention, legal claims, disputes, audit integrity, or compliance obligations.

Additional information about how personal information is handled following account deletion is provided in the PharmaSpark Privacy Policy.

Privacy

Use of PharmaSpark is also subject to the PharmaSpark Privacy Policy.

The Privacy Policy explains the categories of information PharmaSpark processes, why information may be processed, how it may be disclosed, retention practices, account deletion, security practices, and available privacy choices.

You should review the Privacy Policy together with these Terms.

Disclaimers

PharmaSpark is an educational and examination-preparation service and is not a substitute for official information issued by examination authorities, educational institutions, regulatory authorities, or other competent bodies.

To the extent permitted by applicable law, the Service is provided on an "as available" basis.

While PharmaSpark seeks to maintain useful, reliable, and reasonably accurate educational services, we do not guarantee uninterrupted availability, error-free operation, examination success, or suitability for every individual educational objective.

Nothing in these Terms excludes warranties, guarantees, rights, or protections that cannot lawfully be excluded.

Limitation Of Liability

To the extent permitted by applicable law, PharmaSpark is not responsible for indirect or consequential loss resulting from circumstances outside its reasonable control or from unauthorized, unlawful, or improper use of the Service.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

Nothing in these Terms is intended to remove or restrict mandatory consumer rights or remedies available under applicable law.

Responsibility For Misuse

Users remain responsible for their own unlawful, unauthorized, fraudulent, or intentional misuse of PharmaSpark, subject to applicable law.

PharmaSpark may take reasonable action to protect the Service, its users, and its rights where misuse occurs.

This section does not limit rights or protections that cannot lawfully be limited.

Governing Law And Disputes

These Terms are governed by applicable laws of India.

If you have a concern or dispute regarding PharmaSpark, you are encouraged to first contact PharmaSpark through Help & Support so that the matter can be reviewed and, where possible, resolved.

A dispute that cannot be resolved through support will be handled in accordance with applicable law and before the competent courts, tribunals, consumer authorities, or other authorities having jurisdiction.

Nothing in these Terms prevents a user from exercising any right or remedy available under applicable law.

Changes To These Terms

PharmaSpark may update these Terms when its services, features, technology, business operations, security requirements, or legal obligations change.

The current published Terms will identify the applicable version and effective or last-updated date.

Where required by applicable law, PharmaSpark may provide additional notice or seek appropriate acknowledgement or consent before a material change becomes effective.

Previous versions and associated acceptance records may be retained where reasonably necessary for legal, compliance, dispute-resolution, or record-keeping purposes.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be handled to the extent required by applicable law without unnecessarily affecting the remaining provisions.

The remaining provisions will continue to apply to the extent permitted by law.
